Reporting Requirement

Beginning Jan. 1, 2026, pesticide registrants and manufacturers of fertilizers, specialty fertilizers, soil amendments, plant amendments, and agricultural liming materials must annually provide additional information for products that contain intentionally added PFAS

Required product information includes:

  • The name and purpose for each PFAS in the product, including any product components;
  • The amount of each PFAS in the product identified by its name, chemical structure, chemical abstracts service registry number, or other unique method approved by the commissioner, for each PFAS;
  • Any other information required by the commissioner.

A reporting form will be made available soon through which registrants and manufacturers can submit the required information for pesticide, specialty fertilizer, soil amendment, and plant amendment products. Reporting forms must be submitted by the end of 2026, and annually thereafter, for all products containing intentionally added PFAS.

For guidance on fulfilling the reporting requirement for any fertilizer or agricultural liming materials that contain intentionally added PFAS, please contact the MDA at PFAS.MDA@state.mn.us. The required product information must be submitted by the end of 2026 and annually thereafter. 

Extensions for submission of the required information will be determined on a case-by-case basis by the commissioner, if requested.

Data

The data submitted is public under Minnesota law unless it qualifies for protection under the Protection of Trade Secrets laws (MINN. STAT. § 18B.38; MINN. STAT. § 18C.405) or other applicable state or federal law. For data to meet the requirements for protection under the Protection of Trade Secrets laws in Minnesota Statutes 18B and 18C, registrants and manufacturers are required to clearly mark on the form or other submitted materials any data they believe qualify as a trade secret, commercial data, or financial data. Note that merely marking submitted data as a trade secret, commercial data, or financial data is not sufficient to have the data be classified as not public data; the Commissioner of Agriculture makes the final determination on if the data qualify for such protection.
