Pesticide Fertilizer Complaint Form

State law requires that complaints to MDA about pesticides and fertilizers be put in writing and include a description of the alleged improper use, storage, handling, or disposal in order for the MDA to conduct an investigation.

If your complaint is a non-emergency and you would like to discuss the matter before deciding to file a written complaint, please contact the Minnesota Department of Agriculture (MDA) at 651-201-6333 from 8 AM to 4 PM Monday thru Friday. Do not use this form to register general concerns about the use of pesticides or fertilizers, instead, call the preceding number.

Illegal use does not include the use of pesticides or fertilizers in compliance with product labeling or other pesticide or fertilizer laws and regulations.

Illegal use does include specific and verifiable misuse of a pesticide or fertilizer that causes: a) an injury or adverse real exposure to humans or animals; b) damage or contamination of food or feed; c) damage to the environment; d) damage to crops, landscapes, or gardens; e) other misuse; and f) work performed by unlicensed or non-certified persons or companies.

Complaints about damage or contamination to crops, landscapes, and gardens must be reported to the MDA no later than 45 days from the time the application causing the damage that is alleged to have occurred. The MDA may decline to investigate complaints made beyond this time period.

However, MDA places no time limit on the reporting of injury to humans or animals, other serious environmental harm, or for the reporting of persons operating without proper license.

  1. Your identity is protected under State of Minnesota Law. The MDA is not authorized to share this information with anyone except the courts.
  2. Anonymous complaints may not be investigated by MDA except in instances where there is an immediate threat, injury or harmful exposure to humans or animals, contamination of food or feed, or severe damage to the environment.
  3. If this complaint involves a dispute about the use of a pesticide or fertilizer on a property line, the MDA often requires a current property survey to verify lawful property ownership status. If a survey is unavailable, the MDA may decline to investigate the alleged illegal use.
